Terms of Service

Last updated: March 2026. By using DuckSubs, you agree to these terms.

Acceptance of Terms

Agreement
By accessing or using DuckSubs (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. Continued use after changes to these terms constitutes acceptance of the updated terms.
Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater, to use DuckSubs. By using the Platform, you represent that you meet this requirement.

Accounts

Authentication
DuckSubs uses GitHub OAuth for authentication. You must have a valid GitHub account to sign in. You are responsible for all activity under your account.
Seller requirements
To list products for sale, you must connect a Stripe account through the DuckSubs dashboard. Stripe handles identity verification (KYC) independently. DuckSubs does not store your banking information.
Account termination
DuckSubs may suspend or terminate your account for violation of these terms, including but not limited to: listing malware, repeated chargebacks, impersonation, or plagiarism. You may delete your account at any time by contacting support@ducksubs.com.

Buyer Rights

Ownership
When you purchase software on DuckSubs, you receive a perpetual, non-exclusive license to use that software. There is no subscription, no license expiry, and no access revocation. The software is yours.
Downloads
After purchase, you receive a signed download token valid for 48 hours with a limited number of downloads (default: 5). You may generate a fresh download token at any time from your My Purchases page. Download tokens are tied to your purchase record and cannot be transferred.
Refund window
All purchases include a 7-day refund window. If the software does not work as described, you are entitled to a full refund. To request a refund, contact support@ducksubs.com with your purchase details. The developer covers the cost of the refund.

Seller Obligations

Accurate descriptions
Product listings must accurately describe what the software does. Misrepresenting functionality — including falsely claiming your tool replaces a subscription service it does not actually replace — is grounds for removal.
No malware
Software listed on DuckSubs must not contain malware, spyware, cryptocurrency miners, adware, or any code designed to harm the buyer or their system. Violation results in immediate removal and permanent ban.
Support status
Every listing must declare a support status: “Actively Supported” or “As-Is.” This status is displayed to buyers before purchase. If a product is marked actively supported but the developer stops responding, DuckSubs may reclassify the product or initiate abandonment review.
GitHub hosting
All software must be hosted on GitHub. DuckSubs generates download links from your GitHub releases. You maintain your own repository.

Forking Rules

Eligibility
Only Open Shelf products may be forked. Closed Shelf products cannot be forked. Any signed-in user may fork any eligible product, including their own.
Revenue split
Fork sales follow a 70/20/10 split: 70% to the fork builder, 20% royalty to the immediate parent product’s creator, and 10% to DuckSubs. The royalty always goes one level up, not to the original creator of the chain.
Attestation
Before listing a fork, the forker must describe what they changed or improved (minimum 20 characters). This improvement note is displayed publicly. Forks without meaningful changes may be removed.
Lineage and attribution
Fork lineage is permanent and displayed on every product page. Attribution cannot be removed or altered. This ensures buyers understand the provenance of every product.

Platform Fees

Fee structure
DuckSubs takes a flat 10% platform fee on all sales. This is non-negotiable and applies equally to all sellers. Standard Stripe processing fees are charged separately by Stripe.
Fork royalties
For fork sales, the 20% royalty to the parent product creator is deducted before the seller receives their share. The platform fee remains 10% of the total sale price.

Intellectual Property

Seller IP
Sellers retain all intellectual property rights to their software. By listing on DuckSubs, you grant DuckSubs a limited license to display your product name, description, and screenshots for the purpose of operating the marketplace.
Buyer license
Buyers receive a perpetual, non-exclusive, non-transferable license to use the purchased software. This license survives even if the product is later removed from the marketplace.
Fork licensing
By listing a product on the Open Shelf, you grant other users the right to fork your product under the terms described in the Forking Rules section. You retain credit and royalty rights as defined by the fork revenue split.

Refunds & Chargebacks

Refund policy
Buyers may request a refund within 7 days of purchase. The developer bears the cost of refunds — the refunded amount is deducted from the developer’s payout. DuckSubs processes refunds through Stripe.
Chargeback policy
Chargebacks are taken seriously. A first chargeback results in a flag on the buyer’s account. A third chargeback results in a permanent ban from the platform. Fraudulent chargebacks may be disputed through Stripe.

Abandonment & Succession

Abandoned products
If a product marked “Actively Supported” goes unresponsive for an extended period and buyers report issues, DuckSubs may initiate abandonment review. The developer will be contacted before any action is taken.
Succession
Succession does not transfer ownership of the original listing. A successor creates a new product (effectively a fork), and existing buyers of the abandoned product are notified of the alternative.

Limitation of Liability

Platform role
DuckSubs is a marketplace that connects software sellers with buyers. DuckSubs does not develop, test, or endorse the software listed on the platform. All software is provided by third-party sellers.
No warranty
DuckSubs provides the platform “as is” without warranties of any kind, express or implied. We do not guarantee that the platform will be available without interruption or that listed software will meet your requirements.
Liability cap
To the maximum extent permitted by law, DuckSubs’s total liability to you for any claims arising from your use of the platform shall not exceed the amount you paid to DuckSubs in platform fees in the 12 months preceding the claim.

Dispute Resolution

Between buyers and sellers
DuckSubs encourages buyers and sellers to resolve disputes directly. For actively supported products, the developer’s GitHub Issues page is the primary support channel. DuckSubs may intervene in cases involving malware, fraud, or repeated violations.
With DuckSubs
Any disputes with DuckSubs should be directed to support@ducksubs.com. We will attempt to resolve disputes informally before any formal proceedings.

Modifications

Changes to terms
DuckSubs may update these terms at any time. Material changes will be communicated via the platform. Continued use after changes are posted constitutes acceptance. We recommend reviewing these terms periodically.
